A significant area of legal implications revolves around
intellectual property (IP). As Generative AI can produce outputs that may closely resemble or directly utilize existing copyrighted works, understanding the
copyright laws that govern these creations is vital. The
U.S. Copyright Office asserts that, as of now, AI-generated works inherently do not qualify for copyright protection unless they are significantly shaped by human input (
U.S. Copyright Office). This differentiation sets up a unique scenario where artists and creators must navigate carefully.
Since generative AI often learns from a plethora of data, including copyrighted materials, it brings us to the
core issue of copyright infringement. If a generative AI tool learns from art, literature, or music that is still protected under copyright law, any output it generates could inadvertently infringe on those rights. For instance, if tools like
Midjourney generate images heavily inspired by the works of established artists, it raises questions about
derivative works and anyone’s right to compensation (
Holland & Knight).
